Terms of Service

01The subscription

Your subscription gives you access to BuildOn's software development services on a monthly basis. The number of requests handled at the same time depends on your plan:

• BuildOn Pro: 1 active request at a time.
• BuildOn Pro+: 2 requests in parallel.

You may add any number of requests to your queue. BuildOn works through them in the priority order you set, and you can reorder any request that hasn't started.

Large or broad requests (e.g. "build a complete ERP system") are analyzed and split into smaller tasks with clear deliverables. A large request is not treated as a single task to be completed in one go.

02Fees and billing

Subscription fees are billed monthly in advance unless otherwise agreed in writing. Fees paid are non-refundable, except where required by law.

Subscription fees do not include third-party costs. You are responsible for items such as:

• Physical or cloud servers, hosting and operating resources.
• Storage, databases, backups, bandwidth and domains.
• Software licenses, plugins, fonts, images and other paid services used for your project.

BuildOn can recommend or provide suitable infrastructure; in that case, costs are quoted separately based on configuration and actual usage.

03Price changes

Plan prices follow the price list and contract in effect when you subscribe. BuildOn may adjust prices when the cost of AI models changes, for example when an AI provider changes its rates or the service requires more expensive models.

Any change will be announced in advance, stating the reason, the new price and the effective date under the contract.

New prices never apply retroactively to service periods you have already paid for.

04Pausing and cancelling

Pausing: you may pause your plan for up to 3 months at no cost. Unused days in the current billing period are carried over, and BuildOn will resume right where it left off.

Cancelling: you may cancel at any time before your next billing date, with no penalty. Your plan stays active until the end of the paid period.

Unfinished tasks: the end of a subscription month does not mean every request must be finished that month. While your subscription is active, tasks continue in the next period according to the agreed plan. When you end your subscription, BuildOn stops work on unfinished tasks and hands over all completed work.

05Scope of services

The subscription covers software development services such as web apps, mobile apps, APIs and backends, databases, system integrations, AI integration, workflow automation, e-commerce, dashboards and reporting, deployment and DevOps, legacy code refactoring, bug fixes and maintenance.

The following are not included unless agreed in writing:

• 24/7 system operations, on-call and monitoring.
• Purchasing infrastructure, licenses or paid services on your behalf.
• Producing content, images or promotional videos, or running marketing campaigns.
• Accelerated development beyond your plan's capacity (quoted separately).

06Process and acceptance

Each task is tracked in a project management system through these statuses: Analysis → Queued → In development → Testing → Awaiting acceptance → Done.

Timelines provided by BuildOn are estimates to help you plan, not deadline commitments, unless stated in the contract. For requests with a specific deadline, BuildOn needs to assess the workload before confirming.

You may request unlimited revisions within the agreed task scope. Adding features or changing the business scope will be treated as a new task.

07Ownership

Once paid for, all deliverables, including source code, documentation, design files and intellectual property, belong to you.

Open-source libraries and third-party components are used under their own licenses. BuildOn may continue to use general know-how and non-client-specific technical components, and will only feature your project in our portfolio with your permission.

08Confidentiality

BuildOn keeps all non-public information you share confidential, including business data, access credentials and source code, and uses it only to provide our services. We are happy to sign an NDA on request.

09Your responsibilities

To keep your project on track, you agree to:

• Provide timely feedback and acceptance.
• Provide accurate information, content and the access we need.
• Ensure you hold the rights to any materials, data and images you share with BuildOn.
• Not request products that violate the law or the rights of third parties.

10Limitation of liability

To the extent permitted by law, BuildOn's total liability for any claim is limited to the fees you paid in the month before the claim arose. BuildOn is not liable for indirect or consequential losses, such as lost revenue, lost data or business interruption.

11Governing law

These terms are governed by the laws of Vietnam. Any dispute will first be resolved through negotiation; if no agreement is reached, it will be referred to the competent authorities in Vietnam.

12Changes and contact

BuildOn may update these terms from time to time and will notify active subscribers of material changes. Where a signed contract between the parties says otherwise, the contract prevails.
